Mrs. Schotland is senior counsel based in the Washington, D.C. office. Her practice focuses on energy regulation and litigation.
Regulatory Practice: Mrs. Schotland’s regulatory practice involves representation of clients before the Federal Energy Regulatory Commission. Her clients include leading industrial consumers of power, power marketers including financial institutions, traditional utilities, and private equity firms engaged in energy transactions. She currently represents a company seeking to acquire a utility company on the west coast of the United States in FERC proceedings. Mrs. Schotland is a frequent speaker on energy topics. She also authored articles on current topics in electricity regulation and is co editor of the American Bar Association’s revised treatise on Energy Antitrust Regulation.
Litigation Practice: Mrs. Schotland’s litigation practice focuses on antitrust litigation, mass tort litigation, international litigation, and judicial review litigation.
Mrs. Schotland represented GlaxoSmithKline in the Canadian drug importation litigation, in which the Minnesota Attorney General and private plaintiffs’ attorneys challenged pharmaceutical industry restrictions on imports of Canadian drugs to the United States. The trade at issue is worth billions of dollars and the public policy issues are significant. Mrs. Schotland presented oral argument before the Minnesota Supreme Court in connection with this action; on each occasion, the Court ruled in favor of our client’s position.
Mrs. Schotland represented Conoco Oil Company in successfully opposing a private antitrust action seeking to enjoin the merger of our client with Phillips Petroleum. The district court denied the plaintiff’s motion to enjoin the merger for lack of standing.
Mrs. Schotland’s mass tort litigation experience included the L-tryptophan mass tort litigation where Mrs. Schotland had responsibility for multidistrict litigation and supervised litigation and settlement of hundreds of cases. Mrs. Schotland has taught product liability litigation at George Washington University Law School and frequently speaks on product litigation topics.
Representation of non-U.S. clients has been a focus of Mrs. Schotland’s practice. Her litigations have involved forum non conveniens and jurisdictional dismissals, sovereign immunity, alien tort claims, discovery issues associated with foreign defendants and other aspects of transnational litigation. Mrs. Schotland successfully represented a European company in a RICO action pending in the District of Columbia, which was dismissed for lack of jurisdiction. Mrs. Schotland represented one of the Japanese defendants in litigation filed by former prisoners of war seeking reparations for forced labor during World War II. The Supreme Court upheld defendants’ position that the Treaty of San Francisco preempted a California state statute that was enacted to revive such claims.
Mrs. Schotland joined the firm in 1972, became a partner in 1980 and became senior counsel in 2008. She received a J.D. degree from Georgetown University Law Center in 1971 and an undergraduate degree,
magna cum laude, from Harvard University in 1968. Mrs. Schotland clerked for the late Oscar Davis, United States Court of Appeals for the Federal Circuit from 1971-72.
Mrs. Schotland is a member of the Bar in the District of Columbia. She has been admitted to practice before numerous U.S. Courts of Appeal and district courts.
